Minutes of Meeting of Horsington Parish Council on Wednesday 20 April 2022 commencing 7.00pm at Horsington Village Hall.

Ref: 0244/104. Highway/Footpath Repairs Pot holes & maintenance - Updates & Actions:

1. Flooding/Blocked drain/s - Bus stop Lay-by Main Street - flooding ongoing. Clerk emailed Highways to urgently expedite works -  17/03/22 & copied to Cllr PB & included flooding near Moor Lane. Update Response 19-04-22, highways are planning some drainage works as pipes damaged under the road, but no scheduled date available. The teams are overwhelmed with a backlog of works. Will chase for further update.

2. Bucknell to Horsington Rd, footpath overgrown and grass/weeds penetrating through breaking up tarmac surface - Clerk continues to chase. See minuted update below.

3. Potholes  nr Elder Tree Public House. FixMyStreet update - works scheduled. 

4. Footpath Moor Lane - Installation of footpath to assist disabled resident. Moor Lane - Horsington Rd junction. Clerk continues to liaise with Cllr PB & Highways.

a) " Village entry gates" Update: Horsington Parish Meeting (HPM) 16-03-22. Matter considered. Resident survey questionnaire published and circulated - analysis to be completed. Offer by resident at meeting to supply and fit gates FOC. Clerk awaiting further details.

b) Traffic Survey (levels & speeds). Clerk submitted formal request to LRSP & Highways for a review of the 60 mph limit on all the approaches to Horsington & a Enforcement request to Lincs Neighbourhood Police - re noisy speeding motorcyclists' attaching Mr A Garratt's letter & research.

a) New Application: S/089/00389/22. MANOR FARM MAIN STREET HORSIGNTON.

Planning Permission  - Extension to existing dwelling to provide additional floor area. Consultation notification received 10/03/22 response date due 31/03/22. Members considered matter via emails and telephone. Resolved: not to raise any objections. Note: Pecuniary Interest disclosed & Member did not participate in consideration. Clerk circulated details & submitted response 23/03/22.

b) Ref: S/087/01307/21 LAND OFF MOOR LANE Retrospective Planning Permission. Existing Wooden Building Refused 09/09/21. No appeal lodged against refusal as 6 months has lapsed. Clerk chasing ELDC Development Control Enforcement. Meeting Update. 

Ref: 1220/45 Development Control - EC/087/00332/20 Enforcement Notice - LAND OFF MOOR LANE HORSINGTON. Update:  see agenda Item 

c) Ref: S/087/01381/21 SIDE FARM BUCKNALL ROAD HORSINGTON. Planning permission refused 19/08/2021- Erection of a detached house with a detached double garage and construction of a vehicular access. 

Appeal Ref APP/D2510/W/21/3289182 submitted against refusal. Submitted HPC's statement to Planning Inspectorate. Appeal decision 08-04-22 dismissed. Significant conflict with ELDC's development plan policies.

d) Ref: S/087/02645/21 ROSE COTTAGE FARM HORNCASTLE ROAD HORSINGTON. 

Planning permission Change of use of land for the siting of 10 no. touring caravan pitches, a camping field, 8 no. glamping pods, 22 no. glamping cabins and 4 no. underground hideaways and 1 no holiday lodge etc; see full details in Minutes of meeting 16 February 2022 & Agenda of meeting 20 April 2022 & HPC's Resolution. Clerk submitted HPC Resolution consultation response accordingly on 18/02/22. Update: Application Withdrawn 17/03/2022.

Cllr A Reavill updated meeting; Mr D Annekin, has kindly confirmed he will construct the gateways FOC & for HPC to arrange installation. Clerk advised there is funding available (to the proposed sum of £150) from Cllr W Gray's grant. Members Resolved: to proceed subject, to formal consent from Highways. Clerk to submit application once the gates sizes and site locations confirmed.

b) Traffic Survey (levels & speeds). Clerk submitted formal request to LRSP & Highways for a review of the 60 mph limit on all the approaches to Horsington & Enforcement request to Lincs Neighbourhood Police - re noisy speeding motorcyclists'  Clerk update: response received 01/04/22. "Routes will be assessed against speed limit policy & criteria in due course. As there is little frontage development they will be checked against the criteria relating to rural speed limits where traffic volume and number of reported injury collisions are taken into account ... Only where this is calculated at 35 or more can we pursue a speed limit. We have a backlog of requests of this type but will contact you again when our assessments are complete". 

"With regard to the matter of excessive noise the police have a policy relating to noise enforcement and intend to visit the area in due course to investigate. Cllr Mrs Bradwell, copied into correspondence."

0422/106 Update 0222/87 - Emergency Response Plan (ERP) proposals. 

Cllr R Howard (Coordinator) updated meeting following positive responses at HPM on 16/03/22. Initial ERP meeting convened 03/04/22 & minutes circulated. Consideration of possible need to purchase equipment and the storage thereof. Members Resolved:  to support ERP and consider any required funding  in liaison with the ERP committee. Next meeting scheduled September 2022.    

0422/107 HPC's Communications & Website - Chairman's update news letter April 2022 initial draft circulated - clerk edited copy considered - Members Resolved: to approve & distribute final copy. Renewal of LALC website maintenance service 2022/23 - see 0422/109 b).

0422/108 Ref 0222/90 HPC Councillor Vacancy Proposed Co-Option at Annual PC Meeting 11 May 2022. Candidate present at meeting & Clerk advised will discuss forms etc., after meeting. Members Resolved: to proceed with Co-Option.

e) New matter - Clerk advised AGAR Internal Audit is arranged & cost agreed at £30.00. Noted.

f) New matter - Consideration of contribution towards funding Queens Jubilee Event & the Village Hall's over 50's annual Christmas dinner event. Clerk confirmed funds can be allocated. Members Resolved: to fund £150 for Christmas Dinner 2022 & a £400 contribution  towards Queen's Jubilee Event - see item below.

0422/110 Ref 0222/92 Queen's Platinum Jubilee Event participation 2022. Cllr R Hill informed meeting Village Celebration arranged on Friday 3 June for an afternoon tea  & evening entertainment - FOC to residents of Horsington. Details shortly to be circulated.

0422/112 Planning.

No appeal lodged against refusal &  6 months now lapsed. Clerk has chased ELDC Development Control Enforcement. Update.  Response received (20/04/22) from ELDC Senior Planning/ Enforcement Officer - 'advising of site visit a few weeks ago to discuss ongoing matter & advised owner of rights to try and re-apply for permission, but  that any form of residential use is unlikely to be supported, without material details of a justified need. Owner is aware the residential use needs to cease (including the removal of the summer house). Enforcement is being initiated.' 

Clerk response on behalf of HPC 20/04/22 - Expressing surprise at the comment; "Whilst the owner quite within their rights to try and re-apply for permission";  given that the owner has already applied for retrospective residential use & permission was refused and no appeal has been lodged within the 6 month statutory time scale. Clerk referred to ELDC's planning policy grounds for refusal, as set out in the MOOR LANE decision letter dated 09/09/21, which are directly comparable with policy grounds for refusal at SIDE FARM, whereby ELDC refused a new development on 19/08/2021. A subsequent Planning Inspectorate Appeal decision on 08/04/22 upheld ELDC's substantive grounds for refusal. Clerk further commented; "with all due respect, Horsington Parish Council's carefully considered response remains, that any further procrastination in resolving this long running saga continues to be unacceptable".
